The plain-English terms.
No surprises, no buried clauses. This is exactly what you're agreeing to when you buy a website from us — and what we're agreeing to when we take your money.
If anything's unclear, just email us. We'd rather answer the question than have you sign something you don't understand.
01 Who we are
Subpixel Studio is a web design business based on the Gold Coast, Queensland, Australia.
- Trading name: Subpixel Studio
- ABN: 73 690 612 590
- Contact: design@subpixel.com.au
In these terms, "we", "us", "our", and "Subpixel" refer to Subpixel Studio. "You" and "your" refer to the person or business buying our services.
02 What you're buying
We sell custom-designed websites in three flat-priced packages: Starter, Growth, and Signature. Each package has a fixed scope listed on our website at the time you purchase.
We also offer optional add-ons (online store, copywriting, logo & brand kit, SEO setup, content migration) at fixed prices. Whatever you select on our configurator at subpixel.com.au/start is what we deliver.
You pay a fixed price. You get the package and add-ons you selected. We don't do hourly billing or surprise extras.
03 Payment
All packages are paid in full upfront when you place your order. Payment is processed by Stripe, which handles all card details — we never see or store your card number.
All prices on our website are listed exclusive of GST. The 10% Australian Goods & Services Tax is added at checkout and shown clearly in your order summary before you pay. Your final invoice and Stripe receipt will show the GST line separately.
Prices are in Australian Dollars (AUD). If you're paying with a non-AUD card, your bank handles the currency conversion at their published rate.
04 Refunds
We offer a seven-day design satisfaction guarantee:
- If you don't love the first round of designs and you tell us within seven days of receiving them, we'll refund 100% of what you paid, no questions asked, and we'll part on good terms.
- After the seven-day window, or once we move past the first design round and into build, the project is non-refundable. By that point we've already done the bulk of the work.
You get one risk-free week to look at our first designs and walk away with a full refund if they're not right for you. After that, we're committed and so are you.
To request a refund within the seven-day window, email design@subpixel.com.au. Refunds are processed back to the original payment method via Stripe and typically take 5-10 business days to appear.
This guarantee doesn't override your statutory rights under the Australian Consumer Law.
05 Project scope
The package you select defines the scope of your project — page count, included features, and timeline. Anything beyond that scope is considered out-of-scope work.
Revisions
- Starter: 2 rounds of design revisions during the design phase.
- Growth & Signature: Unlimited revisions during the design phase, up until you sign off on the final design and we move to build.
"Revisions" means design changes — colours, layouts, typography, imagery, copy. They don't include adding new pages or features beyond what's in your package.
Out-of-scope work
If you want extra pages, additional features, or a fundamental redesign halfway through, that's out of scope. We'll quote it separately and you can choose whether to add it. Common extras and their fixed prices are listed on our pricing page.
What's never included
The following are not included in any package unless explicitly listed in your add-ons:
- Stock photography licences (we use free or AI-generated imagery by default; paid stock can be quoted)
- Premium fonts requiring a commercial licence in your name
- Third-party software subscriptions (CRMs, email platforms, scheduling tools)
- Ongoing content updates after launch (covered by our Care Plans, sold separately)
- Marketing, advertising, or paid SEO campaigns
- Custom illustrations beyond what's specified (Signature includes some; otherwise quoted separately)
06 Timelines
Each package has a typical delivery window:
- Starter: 7-14 days from project kickoff
- Growth: 3-4 weeks from project kickoff
- Signature: 5-7 weeks from project kickoff
"Project kickoff" means the day we receive your completed brief and all required content (text, images, brand assets if applicable). Until kickoff, the timeline clock isn't running.
If we're late
If we miss the upper end of your timeline window for reasons within our control, we'll let you know proactively, explain what's happening, and apply a 5% credit to your invoice for each additional week of delay (up to 25%).
If you're late
If we're waiting on you for content, feedback, or approvals, the timeline pauses. If we don't hear from you for 30 days during a project, we'll send a check-in email. After 60 days of silence, we may pause the project and resume only when you're ready (no extra cost), or close it out as delivered if the bulk of work is done.
07 What you provide
To deliver the project on time, we need a few things from you:
- A completed brief. We send a link after you pay. It takes about 10 minutes.
- Content (text, images, logos, brand assets) — unless you've added our copywriting or logo & brand kit add-ons, in which case we handle those parts.
- Domain access — if you already have a domain, we'll need login access or DNS authority to point it at the new site.
- Timely feedback. We typically need responses within 5 business days at decision points to keep the project moving.
You confirm that any content you provide (text, images, logos, etc.) is yours to use, or that you have the legal right to use it. If a third party claims content you supplied infringes their rights, that's your responsibility, not ours.
08 Ownership
Once your final invoice is paid (which is upfront, before we start) and the site is delivered, you own everything:
- The complete source code of your website
- All design files we created for your project
- All copy we wrote for your site (if copywriting was included)
- The domain name (registered in your name)
You can move your site to another host, hire another developer, or rebuild it from scratch — without asking us, without any handover fee, without lock-in.
What we keep:
- The right to display screenshots and links to your site in our portfolio and case studies, unless you ask us not to.
- Any reusable code patterns, design systems, or generic components we developed for the project (we may use them on other client work — they aren't trade secrets unique to your business).
The site is yours from launch. The studio's general toolkit (CSS patterns, build setup, etc.) stays ours.
09 Hosting & domain
Year one of hosting and domain registration is included in your package. After year one, you have three options:
- Stay with us: $180/year covers hosting and domain renewal.
- Move to your own host: We'll hand over the site files and DNS access, free, no fee.
- Add a Care Plan: From $49/month, includes hosting, security updates, backups, and small monthly tweaks.
If you don't pay for year-two hosting and don't move the site within 60 days of expiry, the site may go offline and the domain may lapse. We'll send reminder emails at 60, 30, and 7 days before renewal.
10 Cancellation
You can cancel a project at any time by emailing us. Refund policy depends on where we are in the process:
- Within seven days of receiving first designs: Full refund (see Section 4).
- After first designs / during build: Non-refundable. We've done the bulk of the work and committed studio time.
- After launch: The project is delivered. Cancelling at this point doesn't make sense — there's nothing to cancel.
We can also cancel a project — though this is rare. We'd only do so if:
- You don't pay (you've already paid upfront, so this is mostly hypothetical).
- You're abusive to us or our team.
- You ask us to do something illegal or against our values (build a phishing site, scrape someone else's IP, etc.).
- The project is dormant for more than six months despite our check-ins.
If we cancel within the seven-day design window, we'll refund you in full.
11 Warranty & support
Each package includes a free post-launch fix window:
- Starter: 14 days
- Growth: 30 days
- Signature: 90 days
During this window, we'll fix any bugs, broken links, or issues caused by our build, free of charge. This doesn't cover:
- New features or content you want added
- Issues caused by you editing the site
- Issues caused by changes to third-party services (your CRM, payment provider, etc.)
- Browser compatibility issues for browsers more than two major versions old
After the free-fix window, ongoing support is available via our Care Plans (from $49/month) or as ad-hoc work charged at fixed quotes.
12 Liability
We build websites carefully and try hard to deliver good work. But we can't promise the impossible:
- We don't guarantee specific business outcomes (sales, traffic, search rankings) — those depend on factors beyond website design.
- We don't guarantee 100% uptime — hosting providers and the internet itself have outages.
- We don't guarantee compatibility with every browser, device, or accessibility tool ever made — we test current browsers and standard accessibility practices.
To the maximum extent allowed by law, our total liability to you for anything related to your project is limited to the amount you paid us for that project. We're not liable for indirect or consequential losses (lost profits, lost data, business interruption, etc.) except where the law prohibits us from limiting liability.
Nothing in these terms limits any rights you have under the Australian Consumer Law or other consumer protection legislation that can't be excluded.
13 Changes to these terms
We may update these terms from time to time. The version that applies to your project is the one published at the time you placed your order — not whatever's on the site later. We keep a "last updated" date at the top of this page so you can see when it changed.
If you place a new order in the future, the terms in effect at that time will apply.
14 Governing law
These terms are governed by the laws of Queensland, Australia. If we ever can't sort something out between us, the matter would go to the courts of Queensland.
If any part of these terms is found by a court to be unenforceable, the rest of the terms still apply.
